Contracting Training Workshops

Hayslette & Associates offers the following specialized contracting training workshops for government agencies, not-for profit organizations and businesses.

Any workshop can be conducted at the work location or at an offsite location.

Most of the workshops are designed to begin at 8:30 A.M. with an hour lunch break and conclude at 5:00 P.M. and will earn continuing education credits (CEUs) that may be counted toward certification / recertification.

Each workshop will be customized as possible for your organization's specific procedures and needs.

Contracts 101 for Non-Contracting Professionals
This workshop is targeted toward individuals that must either manage a contract process or interface with the contracting authority. Basic contract law terms, concepts, and procedures will be reviewed and discussed. It will discuss the basic elements that must be present for a contract to be formed. The advantages and disadvantages of the different contracting/purchasing methods (bidding, request for proposals, negotiated agreements, indefinite quantity/indefinite delivery agreements) will be identified. The roles and responsibilities of each party to a contract will be discussed including a brief overview of the Uniform Commercial Code (UCC). A boilerplate contract format will be provided. This workshop's emphasis will be on understanding how to develop and manage the contracting process so everyone is successful. While legal terms will be defined and discussed, this workshop is not intended to provide legal advice.

Contract Administration for Non-Contracting Professionals
This workshop is targeted toward individuals that must manage and administer a contract either with or without the assistance of a contracting expert. The basic laws, processes, and procedures for successful contract administration are discussed. Some of the topics to be covered are: planning; receiving, acceptance, and inspection; contract changes and modifications; disputes, defaults and remedies; communications; contract files; payments; and contract close-out. The advantages and disadvantages of the different types of contracts are also identified. This workshop will cover contract administration from the time a need is identified until the final paperwork is archived. [A variation of this workshop is designed specifically for newly elected/appointed officials and leaders.]

Advanced Contract Administration
What do you do after the contract is awarded? What do you do if the contractor appears to be in default? What are your options if the contractor files for bankruptcy? How do you handle a significant change to the scope of work when the project is almost finished? What is a constructive change order and how does it affect the contract price? How do you properly close out a contract? This workshop looks at some of the more problematic practical issues in contract administration and offers sets of solutions as well as resources to find answers. Participation in this workshop assumes the individual has a basic knowledge of contract law and principles.

Contracting for Professional Services
Contracting to buy a dozen widgets is a process that is understood by most management, procurement and administrative professionals, but, how do you successfully contract for professional services like architects, engineers, accountants or auditors, mental health professionals where price is usually not the deciding factor? When contracting for professional services, the bid process is not usually the best vehicle to use. So how do you contract for professional services and still abide by good purchasing practices and get the best solution for your organization? This workshop identifies tools, techniques and methods to successfully satisfy your client's needs and still maintain the integrity of the procurement process.

Performance Based Contracting
How do you ensure that you get the product or service that you have contracted for in a timely, quality manner? The use of a Performance Based contract can provide a successful solution for you and the contractor. This workshop will emphasis the requirements of the scope of work and the metrics of the measuring performance. The advantages, disadvantages and use of incentives, bonuses, cost sharing, fines and penalties, and other reward/punishment methods will be covered. Special contract clauses and procedures will be provided and discussed. Participation in this workshop assumes the individual has the basic knowledge of contracts. This workshop will provide a functional overview of performance based contracting including templates and processes to ensure a successful outcome for all parties.

Writing a Functional Contract
How do you begin to write a functional contract that allows both you and your contractor to successfully complete your respective responsibilities? How do you write a contract that clearly delineates the responsibilities of each party without requiring a legal opinion every time you read the document? This workshop will provide the basic outlines required for most types of contracts and the basic clauses that should be included. The primary emphasis will be on writing a clear and concise statement of work / scope of work. Deliverables, reports, and changes or modifications will also be addressed. Participants should come prepared to actually write a basic contract. While an overview of legal terms will be included, this workshop is not intended to provide legal advice.

Ethics For the Successful Professional
Ethics and integrity play a role in every contracting decision and every action a person makes. What is legal may not be ethical. What is ethical may not seem practical. This workshop challenges the participant to identify his/her own ethics and morals and to apply them to the real world. This workshop will include significant and controversial topics as well as tools to make ethical decisions.
